In the UK statutory maternity leave, paternity rights and adoption rights apply before and after the birth or adoption. Mothers, fathers, partners and adoptive parents are entitled to paternity, maternity or adoption leave and paid and shared parental leave.

Mothers, fathers and partners, including same-sex couples and adoptive parents, are legally entitled to maternity, paternity, adoption and shared parental leave. Other important "family-friendly" measures include unpaid parental leave, leave for emergencies involving dependents, and the right to request flexible work. The following information mainly concerns legal rights. Many employers provide more than these minimum rights in contractual maternity and paternity leave policies. This policy must be current, inclusive and consistent. In addition to imposing minimum statutory leave and paid entitlements, employers can offer flexible working arrangements and an inclusive, family-friendly work environment. Employers must actively support and retain employees in ongoing distressBalance between work and parenting.

The most relevant UK legislation includes the Employment Rights Act 1996, the Employment Relations Act 1999, the Employment Act 2002, the Work and Family Act 2006 and the Children and Families Act 2014.

Any unfavorable treatment of a woman because of her pregnancy, childbirth or maternity may constitute discrimination with regard to pregnancy and maternity. Recent and upcoming changes

Government consultations in 2019 and 2021 considered reforms, including making flexible working standard, unless employers have good reasons not to agree. As part of the consultation response, a new neonatal leave and paid entitlement was announced in March 2020 for working parents whose babies require hospitalization for 7 days or more. prenatal care

Pregnant employees are entitled to paid leave for antenatal consultations and other consultations as indicated by a doctor, nurse or midwife.

Eligible parents and spouses can take unpaid time off to attend up to two of these appointments. This can be paid for and any additional time can be used or used with the employer's permission.

Keywords:

  • Statutory Maternity Leave (SML):Women can take 52 weeks of leave. The leave is not limited in duration, but some statutory maternity benefits are limited in duration.

  • Shared Parental License (SPL): A holiday that can be shared by one or both parents.

The earliest date on which maternity leave can start is the eleventh week before the birth. The woman must inform her employer of her due date and when she decides to start her maternity leave. The employer must respond within 28 days with the expected date of return after maternity leave.

Unless stated otherwise, the employer assumes that all 52 weeks of leave are taken. Mothers can shorten part of their leave to allow their partners to enjoy SPL. If work is resumed earlier than planned, a notice period of at least eight weeks applies, unless a shorter notice period has been agreed.

Mothers are entitled to a maximum of 39 weeksstatutory maternity pay(SMP), must:

  • meet certain lower income requirements for national insurance contributions
  • 26 consecutive weeks of service (assessed 15 weeks before due date).

Some organizations pay more generous contract terms during the furlough period. Women who are not eligible for SMP may be eligiblematernity benefits(Good).

Other benefits during maternity leave

Other than compensation, all contract terms, such as vacation or benefits, remain in effect during the SML. This means that paid leave is accrued during maternity leave. Eligible women have other rights, including:

  • If the maternity leave is 26 weeks or less, return to the previous job under the same conditions.
  • For those who have been on maternity leave for more than 26 weeks, return to the same job or an equivalent job if it is not reasonably possible to return to the original job.
  • A risk assessment is required during pregnancy.
  • Ask about work alternatives that avoid any risk to the health of the pregnant woman or the baby.
  • If health and safety risks cannot be avoided by reasonable changes in working conditions, full wages for the cessation of production.
  • Protection against harm, unfair treatment or dismissal due to pregnancy, maternity leave, etc. For example, female employees cannot return to work because they are breastfeeding.
  • Up to 10 days of "Keep In Touch" (KIT) during maternity leave without loss of any maternity benefits.

The Equality Act 2010 prohibits discrimination in pregnancy and maternity, including salary changes or other conditions.

The main eligibility criteria for basic paternity leave are:

  • 26 consecutive weeks of work, ending in the 15th week before the birth of the baby.
  • The employee must be the baby's biological father or the mother's partner who has (or is expected to take) responsibility for the baby's upbringing.

Unless otherwise agreed, statutory basic leave of up to two weeks must be taken in the following periods:

  • the baby's date of birth or any day of the week, and
  • Up to 56 days after the baby's date of birth.

Employees must notify their employer of their intention to take paternity leave by the end of the fifteenth week before the baby's due date and report:

  • The start date of the license.
  • The week the baby is due.
  • The duration of the license.

Your rights during and after paternity leave

Employees eligible for paternity leave are entitled to:

Since April 2015, statutory adoption and paid leave in the UK have largely aligned with statutory and paid maternity leave, with up to 52 weeks of adoption leave.
